An East Memphis doctor is found guilty of 40 out of 46 federal charges against him, including health care fraud and medical device violations.
Gynecologist Dr. Sanjeev Kumar initially faced 36 charges, but 17 of those were dropped in October of last year.
The federal government then levied 46 new charges on October 30, claiming Kumar “engaged in a series of crimes, frauds, and other acts that abused the trust of both the Medicare and Medicaid programs, and his patients.”
After deliberating for several days, a jury found Kumar guilty of 40 of those 46 crimes on Wednesday:
- 16 counts of adulteration of a single-use device;
- 16 counts of misbranding of the reprocessing of a single-use device;
- 2 counts of adulteration of a hysteroscope clear for reprocessing;
- 6 counts of healthcare fraud.
The jury could not reach a decision on the remaining six and said no more deliberation was needed. The judge declared a mistrial on those charges.


The judge allowed Kumar to remain free until his sentencing, which is scheduled for April 9.
Kumar is accused of performing unnecessary medical procedures, reusing disposable materials, fraudulently billing Medicare and Medicaid, and enticing individuals across state lines for illicit sexual activity, among other things.
He maintains his innocence, speaking to the press alongside his lawyers:
“I feel very disappointed, but at the same time respect the process, and I also firmly believe that I served every patient like a family member,” he said.
“As far as science is concerned, we are confident we are on the right side of the scientific facts,” Kumar continued. “We intend to appeal and try to get justice.”
His lawyer, Ronald Chapman, says the government is trying to criminalize healthcare and that they intend to address issues now that the initial trial is over.
