Tennessee Bill Exempting Fresh Fruit & Veggies From Sales Tax Introduced

The Tennessee Conservative [By Olivia Lupia] –

Another bill concerning grocery sales tax has been introduced by Representative Mike Sparks (R-Smyrna-District 49) as Republicans look to address voter concerns about increasing costs of living.

HB2086 would exempt the retail sale of fresh fruit and vegetables for human consumption from the 4% state sales tax rate. Should the bill pass, it would take effect July 1, 2026.

The bill has just been introduced, so it has not been assigned to a committee, and it does not have a Senate sponsor yet.

A similar bill is being run by Rep. Todd Warner (R-Chapel Hill-District 92) as a revival of last year’s attempt to eliminate the grocery tax for most food products.

HB1530 would repeal the 4% sales tax on food and food ingredients while still allowing local governments to set their own grocery tax.

Under HB1530, items such as prepared foods, alcohol, candy, tobacco, and diapers would still be taxed. 

As the state is anticipating a tight budget year, it is unclear if either of these bills will be made a priority by Republicans with limited funding available when leadership has already indicated an intent to expand the school voucher program.
