The Tennessee Conservative [By Olivia Lupia] –
A bill which would prohibit an artificial intelligence (AI) from impersonating mental health professionals unanimously passed the Senate Health and Welfare Committee on Wednesday, Feb. 4.


SB1580 simply states that “a person who develops or deploys an artificial intelligence system shall not advertise or represent to the public that such a system is or is able to act as a qualified mental health professional.”
A violation of this proposed law would constitute a violation of the Tennessee Consumer Protection Act of 1977 as it would be considered an “unfair or deceptive act or practice affecting trade or commerce,” and could also be subject to an additional civil penalty of $5,000 per incident.
During Wednesday’s committee meeting, bill sponsor Sen. Page Walley said the bill was initially brought to the legislature by the Tennessee Association of Mental Health Organizations and supported by a variety of mental health professionals.


“Artificial intelligence, as we are aware, is a wonderfully powerful tool and has a lot of excellent uses in healthcare, but we believe that if therapy is being provided, that there needs to be a human therapist engaged with the patient and not just a bot,” he said.
There were a few clarifying questions from committee members, and the vote was 9-0 in favor of passage. SB1580 will now head to the Senate Calendar Committee to secure a date for a full Senate vote.


The companion bill, HB1470, is carried by Rep. Tim Hicks and is still awaiting a hearing date before the House Population Health Subcommittee.
