Tennessee Legislation Would Allow All County Residents To Challenge Books At Local Libraries

Legislation introduced in the Tennessee General Assembly would allow all county residents to challenge books with which they take issue at their local libraries.

Sponsored by Representative Johnny Garrett (R-Goodlettsville-District 45), House Bill 2449 (HB2449) is scheduled to be heard by the House Departments and Agencies Subcommittee on Tuesday, March 10th, 2026.

Currently, challenging a book at a public library depends on local policy with some library systems limiting review requests to parents or guardians who live within the library’s district.

Last year, Secretary of State Tre Hargett wrote to libraries receiving state funds, asking for an audit of children’s books to be completed within 60 days in order to comply with state and federal laws.

With the introduction of HB2449, state law could broaden who can ask for a book to either be moved within the library, reclassified, or removed entirely, to any resident who lives within the county.

According to the bill’s language, once a “materials reconsideration application” is submitted to a library, it would need to be sent to the corresponding library board within 7 days. The board would have 90 days to respond to the application, make a decision, and inform the applicant of the decision in writing. All decisions made by the library board would be final, remaining in effect for a “specified time period that does not exceed thirty (30) months.”

The companion Senate Bill 2319 (SB2319), sponsored by Senator Mark Pody (R-Lebanon-District 17) was referred to the Senate Delayed Bills Committee in early February.

In bringing the bill, Pody is seeking to protect children, and has pointed out that some libraries already have a similar process by which residents may request a review.
