Bill Limiting Tennessee Governor’s Emergency Powers Scheduled For Senate Committee

The Tennessee Conservative [By Olivia Lupia] –

Senator Mark Pody’s (R-Lebanon-District 17) SB0027, which seeks to limit the governor’s emergency authority and powers if they contravene or undermine the rights of the citizenry, has been placed on the Senate State and Local Government Committee calendar for Tuesday, Feb. 25.

The bill, carried by Rep. Jody Barrett (R-Dixon-District 69) in the House as HB0324, would prohibit orders, proclamations, or rules issued by the governor under his emergency management powers from suspending or conflicting with any part of the Tennessee Constitution.

It would ultimately restrict the governor’s ability under such powers to suspend certain procedural provisions of a law, order, rule, or regulation. The legislation would not impede the governor’s ability to issue executive orders or proclamations in emergency times but instead ensures they do not suspend citizens’ constitutional rights.

HB0324 has been assigned to the House Public Service Subcommittee but does not yet have a scheduled date.
