The Tennessee Conservative [By Adelia Kirchner] –
State Representative Gino Bulso (R-Brentwood-District 61) is sponsoring House Bill 64 (HB0064), which would require that all residential educational programs in Tennessee segregate their restrooms, changing areas, and showers according to “immutable biological sex” if such program allows minors to participate or to access residential facilities.
The legislation was filed for introduction on Tuesday of this week.
The bill amends Tennessee Code Annotated (TCA) Title 49, Chapter 6, Part 3, applicable to elementary, middle, and secondary schools, by adding the following section:
“All residential educational programs in this state, regardless of type or duration, that allow minors to participate or to access residential facilities must segregate all restrooms, changing areas, and showers by sex, as defined in § 1-3-105(c).”
TCA § 1-3-105(c) defines “sex” as “a person’s immutable biological sex as determined by anatomy and genetics existing at the time of birth and evidence of a person’s biological sex.”
According to that same code section, “evidence of a person’s biological sex” includes but is not limited to, “a government-issued identification document that accurately reflects a person’s sex listed on the person’s original birth certificate.”
HB0064 would also add this new section to TCA Title 49, Chapter 50, Part 8, applicable to private schools, and TCA Title 49, Chapter 7, Part 1, applicable to postsecondary and higher education institutions.
If passed by the legislature, this act would take effect immediately upon becoming law.
