A resolution that could result in a constitutional amendment effectively banning a statewide property tax in Tennessee is scheduled for consideration by the Senate Judiciary Committee this Tuesday.

Senate Joint Resolution 1 (SJR0001), is sponsored by Sen. Ferrell Haile (R-Gallatin-District 18).

According to the bill summary, SJR0001, is “a resolution to propose an amendment to Article II, Section 28 of the Constitution of Tennessee, to prohibit taxation of property by the State.”

This legislation would prohibit the general assembly from “levying, authorizing, or otherwise permitting a state tax on property.”

Currently, the list of co-sponsors includes Republican Senators Lowe, Walley, Bailey, Johnson, Briggs, White, Hensley, Pody, Stevens, Massey, Roberts, Rose, Harshbarger, and Seal.

During the 2024 legislative session, the Tennessee House and Senate both passed a joint resolution on the subject, beginning the process to amend the state constitution.

If this year’s resolution passes with a 2/3 majority vote in both legislative chambers, the constitutional amendment will be voted on by Tennesseans in 2026.

SJR0001 is currently scheduled for consideration during the 3pm (CST) meeting of the Senate Judiciary Committee on Tuesday, Feb. 25th, 2025.
