This happened in Scotland where a trans woman who’d been housed in a women’s prison after a murder conviction was accused of sexually assaulting a woman.
A transgender prisoner serving a sentence for murder has been charged with the sexual assault of a fellow inmate at a women’s prison.
Alexandra Stewart, previously known as Alan Baker, allegedly attacked the woman at HMP Greenock…
Stewart – thought to be one of two trans women in the female prison estate – was jailed for life after murdering Weir, 36, by stabbing him 16 times at his home in Bonhill, West Dunbartonshire.
The question of whether or not trans women should be housed in women’s prisons should have been settled last years when the UK Supreme Court ruled that the term “woman” referred to sex. But an activist group called For Women Scotland has been sued the Scottish government over it’s refusal to abide by the ruling.
The alleged incident comes amid an ongoing legal battle between For Women Scotland (FWS) and the Scottish government over the management of transgender prisoners…
Current SPS guidance allows for a transgender woman to be admitted into the female estate if the inmate does not meet the violence against women and girls criteria, and there is no basis “to suppose” they could pose an “unacceptable risk of harm” to those also housed there.
FWS is arguing the policy is “inconsistent” with the Supreme Court judgment.
Susan Smith, the director of For Women Scotland, had plenty to say in light of the alleged assault.
Smith said: “The bottom line is that this is always a risk when you have mixed-sex spaces, and it’s always been completely insane for the Scottish Prison Service to argue that they can assess risk on this level. We can’t prejudge this particular case but we do know that most rapes and attempted rapes go unreported, so we have no real idea of which individuals pose this sort of threat to women.
“It has been a dangerous and stupid experiment to allow prisons to be mixed sex, and it’s having a severe impact on the human rights of the women in the prisons. Maybe now the prison service and the Scottish Government can wake up and realise that what they’ve been doing presents a clear and constant risk of state-sanctioned sexual assault – no matter what the outcome in this case it should sharpen minds to that reality.”
Author J.K. Rowling also commented, saying this attack was entirely the fault of the Scottish government and offering to help the victim sue.

Despite this obvious demonstration of the fact that placing men in women’s prisons is a bad idea, Green Party leader Zach Polanski still prefers to make case by case judgments.
Speaking on a visit to Glasgow to campaign for the Holyrood elections, the Green Party leader in England and Wales said that a ban would result in trans men, who are born female, serving their sentences in female jails.
Mr Polanski urged Rowling to have more compassion and argued that trans people “just want to pee in peace”.
Stewart has been held in prison as a woman since 2016…
…prisoners in the all-female wing were said to be furious that the SPS allowed Stewart to live in the facility despite being biologically male.
Obviously, someone judged that Stewart aka Alan Baker was a good risk. And for several years that worked out…until it didn’t. Now a woman in prison has been assaulted (allegedly) by a biological man. Being more compassionate to trans people won’t help the victim or prevent this from happening again.
