Joe Biden is not guilty because of senility.
Sure, he broke the law–the same law used to prosecute Donald Trump by Joe Biden’s Justice Department. But he is an old man who is utterly incapable of remembering when he was Vice President, so there is no point in prosecuting him.
That is the conclusion of Special Prosecutor Hur, who was tasked to investigate President Joe Biden in the matter of his stealing classified documents.

First, let me be clear: I think that in both the Trump case and the Biden case, we should neither be surprised that men who were at the pinnacle of power in our government would treat classified documents differently than you or I would, and I think prosecuting them for mere possession (and not selling them) is simply stupid.
What they did was wrong, but, well, they were President and VP, not a Seargent who leaked the plans to a submarine. If you think such people ever live by the same rules as us, then…well, you get the idea. I’m a lot more worried that John Kerry flew around the world meeting with our enemies than that Trump had boxes of documents moldering in his bathroom.
Biden? The man is a menace and should never be near anything that we don’t want in the hands of the Chinese, but again…it’s worse that Hunter has access to the White House and regularly talks with the president, but what can you do?
So in my view, the real news coming from both of these investigations has to do with the men and the ways that Washington works.
And the biggest news of all is that Joe Biden will get off not because he is a powerful man, but because he is senile. Literally, that is what the Special Prosecutor’s rationale is for letting Biden off the hook.

The Special Counsel begins his report without burying the lede: Biden is guilty of the charges but declining to prosecute.
Well, we all knew the first thing and expected the second. What we didn’t expect was the rationale for why the Special Prosecutor would do so.
Biden’s brain is gone. He can’t remember basic things, like when he was Vice President or even when his son died.
Mr. Biden’s memory also appeared to have significant limitations-both at the time he spoke to Zwonitzer in 2017, as evidenced by their recorded conversations, and today, as evidenced by his recorded interview with our office. Mr. Biden’s recorded conversations with Zwonitzer from 2017 are often painfully slow, with Mr. Biden struggling to remember events and straining at times to read and relay his own notebook entries.838
In his interview with our office, Mr. Biden’s memory was worse. He did not remember when he was vice president, forgetting on the first day of the interview when his term ended (“if it was 2013 – when did I stop being Vice President?”), and forgetting on the second day of the interview when his term began (“in 2009, am I still Vice President?”).839 He did not remember, even within several years, when his son Beau died.80 And his memory appeared hazy when describing the Afghanistan debate that was once so important to him. Among other things, he mistakenly said he “had a real difference” of opinion with General Karl Eikenberry, when, in fact, Eikenberry was an ally whom Mr. Biden cited approvingly in his Thanksgiving memonto President Obama.
There is a lot to digest in the report, but even more to digest in how it was reported when it dropped.
It was treated as a big nothing by the media–The Wall Street Journal reported it as if the Special Counsel found almost nothing at all.
Here’s the lede on their initial story:
President Biden was sloppy in holding on to classified material related to some of his most consequential policy debates as vice president, eager to show that history would prove him right, according to a special counsel investigation that yielded no criminal charges but is likely to add a fraught new dynamic to the 2024 presidential contest.
The report didn’t say he was sloppy. It said much the opposite, in fact: he willfully took and disclosed classified information, which in no way is “sloppy.”
What the report actually said was that Biden was guilty, but a jury wouldn’t convict him because he is an old man who can’t remember things.
We have also considered that, at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory. Based on our direct interactions with and observations of him, he is someone for whom many jurors will want to identifyreasonable doubt. It would be difficult to convince a jury that they should convict him—by then a former president well into his eighties-of a serious felony that requires a mental state of willfulness.
We conclude the evidence is not sufficient to convict, and we decline to recommend prosecution of Mr. Biden for his retention of the classified Afghanistan documents.
There will be a lot of discussion about a two-tiered system of justice, and that is absolutely correct. But far worse, in many ways are two other things: the failure of the MSM to even try to present the truth–at least the first version of their story appears to be that Biden was simply careless, not “willful,” and most importantly their unwillingness to focus on the fact that the Special Counsel has essentially said that Biden is non compos mentis.
You would think that the news that a Special Prosecutor is declining to prosecute a President based on his assessment that he is mentally incompetent would be news worth leading with. Whether Biden faces a jury in Washington DC or Deleware is a minor footnote to that.
But no, not in MSM land.
The Times briefly mentioned that Hur had noted memory lapses in his investigation, but chose to focus on the political implications for…Donald Trump.
“Mr. Biden would likely present himself to a jury, as he did during our interview with him, as a sympathetic, well-meaning, elderly man with a poor memory,” Mr. Hur wrote.
It would be difficult to convince a jury after Mr. Biden left office that “a former president well into his 80s” was guilty of a felony that “requires a mental state of willfulness,” Mr. Hur added.
But Mr. Hur’s assessment will provide potent new political arguments for President Donald J. Trump in his battle to discredit the department over its far more serious investigation into his retention of classified materials, which resulted in criminal charges last summer. Mr. Hur’s report includes a photograph of the open box where the F.B.I. found classified Afghanistan documents in Mr. Biden’s cluttered garage, next to a ladder and old exercise equipment.
The President of the United States doesn’t remember when he was elected VP, when he left office, when his son died within a span of YEARS, and the big thing is that Trump will use this report to challenge the Justice Department’s fairness.
This is, of course, insane.
The man with his hands on the nuclear button is senile, and the MSM worries that Donald Trump might benefit from this report.
Geez.
Now, of course, one of the reasons they aren’t worried is that everybody knows that Biden is simply a figurehead with the influence of Vladimir Lenin’s corpse on policy. He is a symbol who barely can walk and talk, and others (Barack Obama and company) are really running things.
Even MSM reporters might be concerned if they thought a man incapable of remembering his son’s death was in charge of the US government, but everybody knows that is fiction.
This is how communist governments worked. In its declining years the Soviet Union chose its leaders this way. Konstantin Chernenko “led” the Soviet Union for a year, and he looked as healthy as Lenin did in his tomb. That is Joe Biden today, and apparently, the apparat in Washington like it that way.
So the story in the media is that Biden was exonerated, and they gloss over the very real findings that Biden’s brain is mush.
This is the real story of corruption. I think Hur is right that no jury would convict Biden–think of where the trials would be held and whether he would have made a different decision if the parties were reversed in almost irrelevant to me compared to the fact that our news media is unwilling to report the basic fact that our president is mentally incompetent.
Our media is even more corrupt than our government.
