The Tennessee Conservative Staff –
A bill that would prevent lower courts from hearing cases that involve or interfere with Tennessee House and Senate rules is scheduled to be heard by the Senate Judiciary Committee on March 11.
Senate Bill 2225 (SB2225), sponsored by Senator Adam Lowe (R-Calhoun-District 1), states that “no circuit, chancery, or other court has subject matter jurisdiction over any legal action, challenging any rule, regulation, or procedure of the senate or house of representatives.”
Sponsors have previously stated that the purpose was to establish that the legislature controlled the lower courts, instead of the lower courts having control over the legislative body.
Companion House Bill 1652 (HB1652) passed on the House floor on March 4 after a contentious vote that saw several Republican Representatives voting against the legislation alongside Democratic representatives, while several others opted to be marked as “present not voting.”
